Rights of Accused Student

The accused student is entitled to the following:

1. The choice of pleading "in violation," "not in violation," or "no contest."

2. The right to review relevant evidence and documents included in his/her disciplinary file.

3. A review of the hearing options and the format of the hearing which includes the right to call witnesses and to be accompanied by an appropriate advisor (see section titled "Advisor to the Accused Student or Accuser" for more information).

4. The right to refuse to answer questions.

5. The right not to be subjected to duress or threats or any form of coercion in order to gain an admission or "in violation" or "no contest" or to gain information about the conduct of other suspected persons.

6. A review of the appeal process.

7. Right to appeal.


APPEALS

A student found "in violation" of the Albright College Student Code of Conduct in any of the hearings may appeal the decision. The student must file a written appeal directly to the Provost for academic violations or to the Vice President and Dean of Students for social violations within five (5) business days (days that the College is open) of receipt of the decision. The basis of appeal must meet one of the following criteria:

1. procedural violation, or

2. new evidence that was not available at the time of the hearing

The appellant (accused student) may be interviewed at the discretion of the Vice President and Dean of Students. Students will be notified of the appeal judgment within five (5) business days (days that the College is open) when possible. All sanctions are delayed until the appeal decision is made.
